SUCCESS STORY: PRIMUS DERLING provided legal support to ŠKODA VAGONKA when entering a procurement contract with AS Pasažieru vilciens on the supply of 32 electric trains

We are truly happy and pleased that the procurement procedure that continued for almost four years has been successfully completed – ŠKODA VAGONKA a.s., represented by PRIMUS DERLING, has signed a contract with AS Pasažieru vilciens for the production and supply of 32 new electric trains. New electric trains will be phased in – the first trains will be delivered in the first half of 2022, but by the end of 2023, all 32 new trains will be used to provide passenger transport service.

The contract for the purchase of electric trains, which includes staff training, equipment for maintenance and a spare parts fund, amounts to EUR 241,888 753.

PRIMUS DERLING provided support to ŠKODA VAGONKA a.s. throughout the entire public procurement procedure starting from the preparation of candidates’ qualifications documentation and tenders and ending with the challenge of the initial results of the negotiated procedure before the Procurement Monitoring Bureau and the representation of the interests of the client as a third party before the Procurement Monitoring Bureau when the applications filed by a Spain-based company Patentes Talgo S.L. were examined. Having re-assessed the tenders submitted, AS Pasažieru vilciens declared that the contract would be awarded to ŠKODA VAGONKA a.s and on 28 June 2019, the Procurement Monitoring Bureau authorised the contract award to ŠKODA VAGONKA, rejecting the complaint filed by Spain-based  Patentes Talgo S.L.

The expert team of PRIMUS DERLING was composed of partner Kristīne Gaigule-Šāvēja, senior associates Andis Ozoliņš and Konstantīns Teļakovs, associates Igors Dambrāns and  Edgars Pundurs.
